1:39 pm
4 hundred units plus. the office of community infrastructure the successor to the redevelopment agency is to be consistent with the hunters view shipyard plan and the bayview hunters point and candle stick shipyard development plan. those plans were approved by the board of supervisors in 2010. the planning department has vermd the proposed vacation of the easements are in empowerment with the general plan and restores the county city surveyor i'm available for questions >> no thank you very much. >> okay. at this point weigh go to. i have two public comment cards

1:42 pm
>> you know that there are only two speakers here and their giving us only two minutes. we need real people to represent san francisco. we have somebody in district 10 that has no clue. first and foremost and the attorneys know and anyone who knows about land use is we can't take a one hundred 3 acres in this case without first having a meeting with the fact so no meeting was held and suddenly 3 hundred acres were declared a survey area we intended all the meetings so we know what we're talking about.
1:43 pm
but now suddenly dpw is coming her and saying no, we need this land vacated so he can do our infrastructure on land that is in filled the worse type and is prone to flooding that you have several representatives that have rubber stamped and attorneys that can't stand up i'll call them boovendz who does not represented our country and not represent our nation don't represent san francisco. can you image what you're all doing. the process has not been followed. what is important to note is that some people should be taken to court you, you using the act.
1:44 pm
thank you very much >> is there any additional public comment on items 1 and two. seeing none, public comment is closed. okay. if there's no additional questions or comments colleagues i'll entertain a motion to forward item one to the board without recommendation for a hearing on april 8th and item 2 forward to the board with recommendations as a questioning committee report >> so moved. any decision on the motion then we'll take that motion without

1:46 pm
license for the alcohol district use. >> thank you. >> all right. thank you. >> thank you. >> okay. we'll open item 3 for. is there that any member of the public who wants to comment on item 3 seeing none, public comment is closed. supervisor cowen would you like to make a motion >> i'd like to move item 3 as a recommendation for the committee report. >> we'll take that without objection. >> madam clerk, can you please call item 4. >> it's a resolution approving the authorization for the temporary license for the safety for the general hospital. >> okay. and we have john updyke from the department of real estate.
1:47 pm
>> good afternoon chair wiener i'm john. this item is a 10 year un150i7b8 non-positiony license to the university of the california in certain areas of the canvas. this allows uc to install and maintain the safety enhancements to protect passersby given the seismic conditions with barrier landscaping and one protective can mississippi that i and access points and roof tile reenforcements. i want to highlight quickly where those encroachments are located on the campus. if we can go to the overhead.
1:48 pm
so this shows a particular improvements the blue being the areas of the fencing and the green new areas of landscaping. the orange areas some roof work and also some enclosure changes noted in the red. this license grants uc the right to brace their enlistment the terminal license is 10 years and the maintenance is borne by uc. the city's costs will be simply related to the increase in landscaping expenses. there are robust review and approval processes set forth under the lease. the addendum dated as to the general eir of 2008 that is referenced in the board file is
1:49 pm
to address the improvements and planning be issued a memo saying those don't change the sequa finding so their included in your board resolution. on february 4th the commissioner lee commission heard and approved those licenses and i have staff from the hospital here >> colleagues, any questions. okay. then at this point we'll open item 4 up for. any public comment on item 4? seeing none, public comment is closed. colleagues could i would entertain a motion to the full board with positive recommendation can we take those without objection? madam clerk, call item 5 >> item 5 is an ordinance in the administrative code with the
1:50 pm
address eviction for the reassistance code. >> supervisor campos i is the author and we'll give him a moment to get here. i hear him (laughter) >> welcome supervisor campos do you need a moment or are you ready to go? okay. it's all yourselves >> thank you very much i want to begin by thanking my colleagues on the land use committee and thank you platform for putting this item on the calendar. we're here to talk about an important piece of legislation that's the result of a long community process that has involved tenant from thought the
1:51 pm
city. as part of a pretty robust and growing tenants movement in san francisco. to come up with solutions to deal with the affordability crisis and to deal with the fact as we're speaking people are facing eviction in san francisco and the long-term solution is to create affordable housing and change state law to address the speculation that is happening in different parts of the city. in the meantime, as we wait for that law at the state level to be changed we need to take action to help people facing eviction today. we're moving in an affordability crisis and i know we had heard a lot of stories from people through the district and part of
1:52 pm
the city so we have a study of whether or not the things we were seeing were happening and to have numbers to back up. the study showed we have one hundred and 70 percentage increase in ellis act evictions and the study also showed what we saw was the gibb of a trend and bend the calendar ends the evictions will be higher. some of the advocates have pointed out that the renters were talking about more than that 3 hundred units that will face the eviction and that's condone by the displacements that happen through buy outs are
1:53 pm
not even reported and currently not regulated. as weaponry looking into the existing law in san francisco we were shocked to learn if you're facing on ellis act eviction the most you can collect is $5,200 from your landlord anyone who has tried to rent in the castro 5 thousand plus didn't take you far. so that will mean i'll have to leave san francisco. that's why the legislation that was discussed at the various conventions and is consistent with the federal government steps in and tries to take the property through eminent domain and ties the relocation costs
1:54 pm
not to an ash tree number to 10 thousand as suggested but to the market. what would it take foyer a san francisco tenant to be able to stay in san francisco. so this legislation requires that the landlord pay the difference between the tenants rental rate prior to the eviction and what would have been the market rate for that unit for 10 years. this formula will assure with the payments represent true market costs and allow the tenants who face the dramatic rent increases in san francisco the opportunity to actually stay in san francisco. it's not the solution but it gives them a fighting change. the rental prices in san francisco have increased since 2005 which is actually, the last
1:55 pm
time we passed on ordinance requiring the ordinance. a lot of has happened since 2005 in san francisco. we now in san francisco have the highest rent in the country higher than new york city. currently as was noted the amount that's being required for relocation is very low. so when you look at it in the complex of what's happening in san francisco you can see why it is important. crossing the zero.com agency of june 2013 last time the city medium was 3,0004 hundred and $14 a month. that's the amount as of june 2013 that the amount has probably gone up 3 thousand 5
1:56 pm
hundred doesn't mean much when the rental is more. the people he leah are not only native san franciscans but people who have made a life here in san francisco who have lived decades and years and who have dedicated themselves to the neighborhood my community. the face of the neighborhoods are changing and changing the face of san francisco. it's not something that was focused on one parrot of town but happening throughout the city. their people like blanca reece >> she works as a caregiver with seniors and her daughter ask a constitute at san francisco state university
1:57 pm
they're facing an ellis act in the neighborhood and its people like jeremy michael's a gay who came to san francisco from ohio more than thirty years he's fighting an eviction after living in the csa afro-electro for 17 years and people like daniel whitaker who had to stop working because of a dablt and prior to that distract go sdrablt and the more you learn about the challenges that the tech workers face when you talk about the tech workers in the community they're the same issues facing the long term
1:58 pm
residents are facing those folks. this ordinance is an important step in finding a solution and it will help tenants and it's needed now. in fact, if anything i worry about we could have introduced this legislation months ago it would have benefited people that are unfortunately not living in san francisco any longer. we continue to work on fixing state law that's part of the steam it's important for us to act quickly today to bring this item to the board as as quickly as possible i respectedly ask for the support of this committee i want to thank the following combhbz. supervisor kim. supervisor avalos and supervisor
1:59 pm
mar. with that mr. chairman, i want to call upon ted who will talk about the memories of the legislation and how the planner will use the estimated market rate which a unit to figure out how the relocation payment will work. actually >> i'll give my colleagues an opportunity. >> supervisor cowen are you intending to over an amendment. >> okay. >> supervisor kim. >> thank you chair and supervisor avalos for bringing this legislation. i'm happen to co-sponsor this legislation for all the reasons we know that ellis act evictions are one are part of the things gripping san francisco and the rents have skyrocketed.
2:00 pm
many tenant are willing to go but when they try to figure out where they're going to move and they discover their permitted out of the system and the reassistance payment doesn't help with the first 3 months of rent. it's important as we look at this issue we try to address one of the negative consequences of it that people have no more to go this is one piece that addresses that and it's important to address the relocation 35i789s as the market gets hotter. this will help to mitigate the prying and, of course, moving costs associated with new utility hook up.
